TERMS AND CONDITIONS OF SALE

Our acceptance of your order is made conditional on your agreement to the terms and conditions as stated on this page.

MINIMUM ORDERS

Our minimum wholesale order is $200.00. The minimum reorder is $100.

TERMS

All new accounts are shipped Pro-Forma or Prepaid.

Pro-Forma: All new businesses or new ownership of business will also only be shipped Pro-forma. All checks will have to clear before we ship your order. Please provide us with the phone number of your bank. Any orders that are to be reserved or picked up need to have a minimum 20% deposit placed. No items will be pulled from inventory and/or uncrated prior to receipt of this deposit. Deposits are non-refundable.

COD: We will only ship COD “check” after a complete credit check; otherwise COD Cash only terms will be required.

NET 30: N30 Terms are granted only on repeat orders. A Marquis credit application must be filled out and signed. Please submit 6 credit references with complete addresses, account, phone and fax numbers.

Marquis reserves the right to refuse credit and/or cancel any order(s) from any business/individual, for any reason, at any time.

ALL GOODS ARE INSPECTED

All items are HANDCRAFTED from NATURAL MATERIALS (stone, shell, coco, leather, etc.). Variations in the natural materials highlight the unique qualities of each piece. All pieces are hand-made and hand-finished. No two pieces will be exactly alike. We have 4 separate post production QC inspections.

AVAILABILITY

All items are usually in stock for immediate shipment.

FREIGHT/DELIVERY

All orders are shipped FOB, Marquis warehouse, Los Angeles, California. (FOB means Free on Board and that Ownership of the merchandise transfers to the customer as soon as the merchandise is picked up from the Marquis warehouse by UPS, Common carrier, Truck, Delivery Service, Customer vehicle, etc.) Note: Common Carriers/Trucking Companies are not responsible for unloading merchandise from the truck. Marquis will try to find the most economical way to ship your order. Any special shipping instructions must be indicated on the order form. Export shipments are also accommodated.

Customer is always responsible for ALL freight charges.

DELINQUENT ACCOUNTS

No orders will be shipped until overdue balances are cleared. Legal interest of 1.5% per month will be charged on past due or delinquent accounts. If an account is placed for collection, all fees and costs incurred by Marquis Collection will be charged to delinquent account. Any disputes will be settled in a Los Angeles court.

RETURN CHECK FEES

All returned/bounced checks will be assessed a $25.00 charge.

SPECIAL ORDERS

We accept Special Orders with a 50% down payment, and the balance due prior to delivery. Normal delivery times for special orders may be between 2-3 months. Intricate orders may take 3-6 months. Orders must be in writing. Line drawings will help expedite your order.

DROP SHIPMENTS

Drop shipments are accommodated. Orders must be mailed or faxed in.

BACKORDERS

All backorders are shipped unless advised otherwise in writing.

DAMAGED SHIPMENT

Please do not discard the packing materials until you have checked the merchandise received. Discarding the packaging may invalidate any freight claims. In the event of missing pieces or damages that can’t be repaired, you must make a notation on the delivery receipt, REFUSE the damaged item(s), and you must call or fax us at Tel.(310) 719-7192 or Fax. (310) 719-1525 immediately after receipt of the shipment in order for us to help you process your claim. The following information is needed: [a] Description of damaged item; [b] Condition of outer packaging; [c] Tracking number; and [d] Invoice number. Please inspect the cartons/crates carefully. If you suspect that there is even the smallest sign of wear / slightest chance of damage, even if you can’t see it, just mark it on the B/L of the carrier. If you do not mark the B/L, the claim will be for “concealed damage” and it is harder to collect. The longer you wait, the harder it will be to get your claim processed. Most carriers will not even accept any claims after 15 days.

RETURNS & EXCHANGE - We Will Not Accept Unauthorized Returns.

Authorization for credit or the return of damaged or incorrectly shipped merchandise must be phoned or faxed WITHIN 5 DAYS OF RECEIPT OF MERCHANDISE. Only damaged or incorrectly shipped items may be authorized for return. We will give you an RMA (Return Merchandise Authorization) number, as well as the “SHIP TO” address for the merchandise to be returned to. ANY shipments or part(s) of a shipment refused or returned without prior authorization will subject the customer to a 25% (of invoice value) restocking fee, plus freight. Customer is responsible for ALL freight charges and for making sure that items authorized for return are packed properly.

CANCELLED ORDERS

All orders that are placed (verbal, written, faxed or otherwise) are considered confirmed orders unless they are marked H.F.C. (hold for confirmation), and if cancelled, will be subject to a cancellation fee of 25% of invoice value or at a percentage management deems appropriate.

CHANGES

All prices and sizes are subject to change without prior notice.
